The Dobbs decision fallout will find new uses for everything from surveillance to no-knock warrants to police tanks.
Here it comes, folks! A Texas judge wants to make an FDA-approved legit medication the new crack cocaine. Right on cue, the right-wing bat guano Nationalist faction of the courts has laid out plans to win the war on abortion by declaring an endless extension to the failed drug war.
It was bad enough when the DEA, by its own authority, banned overnight all MDMA use (also known as Ecstasy or Molly). Why? Drugs are bad, mkay? Despite being used as a drug to enhance therapy in severe trauma patients (such as PTSD), the government decided the war on everything was not large enough, so it expanded the war again and again and again. It has expanded that war without many positive results, in fact, often negative ROI, including an ever-increasing cost to taxpayers. Oh, and murdering innocent civilians (more on that later). But now U.S. District Judge Matthew Kacsmaryk for the Northern District of Texas has singlehandedly decided he is personally in charge of all drug approvals, not the FDA, doctors, and researchers, past, present, or future; for all patients, regardless of the medical condition, in every state and territory. Kacsmaryk, a Dear Leader Porn Star Humper appointee, was hand-picked for this appointment to the federal courts and this decision because his views were already well-known as a far-rightwing theocratic lawyer in a holy roller legal group looking to ban everything from medicine to asylum-seeking to the separation of church and state. Their main legal theorem appears to be Christians are aggrieved so the rules don’t apply to Christians. In Animal Farm, the rules did not apply equally; remember the last rule was changed to "All animals are equal, but some animals are more equal than others."
MDMA has been looked at for assisting the treatment of military veterans with PTSD. Helping veterans recover from trauma is not a legit use case? You evil bastards.
Oh, and it is amazing how Christian Nationalists fawn over everything about Israel, but they have to ignore that MDMA treatment is supported for their veterans suffering from PTSD and they increased access to pregnancy termination procedures after the U.S. Dobbs’ decision. Oh, and weed is decriminalized and they are thinking of full legalization Colorado-style.
Kacsmaryk’s far-right theocracy group was behind the school football coach case where the coach was indoctrinating players into Christian Nationalism whether the kids (or parents) liked it or not. The school is secular but that did not matter. Kascmaryk’s group shopped federal court judges until they got the decision they wanted and then off to the now far-right-controlled and clearly theocratic SCOTUS for the decision that can only be described as the first step to throwing out the prohibition of the establishment of a state religion under the 1st Amendment.
Kacsmaryk was shopped in the mifepristone, aka the “abortion drug,” case too. The court game is rigged. It is a well-known and understood strategy of the far-right Nationalists. Create a law that you know would be generally illegal and/or unconstitutional according to legal precedent. Shop for the zealots who were just appointed to the federal bench who are pining for a dystopian Christian ethnostate. Then get the decision your illegal/unconstitutional bill was created specifically for, throwing out standing legal precedent. Then go to zealot Justice Amy and the drunken & rapey Justice Brett to rubberstamp the theocracy by destroying the legitimacy of the constitutional court and destabilizing the entire experiment we call a democratic Republic. Since its founding, a secular democratic Republic.
Given Kacsmaryk’s and his Christian Nationalist legal activist group’s history, y’all should be terrified unless you are already a Christian nutter playing the victim. The court decisions Kacsmaryk’s group sought are fraught with hypocrisy. A Christian US Post Office employee is discriminated against because “he is forced to work on the Sabbath.” This is the whole Leviticus ruse Christian nutters have been using since Lee Atwater’s Christian Voting Block myth declaration.
“Six days shall work be done, but on the seventh day is a Sabbath of solemn rest, a holy convocation. You shall do no work. It is a Sabbath to the Lord in all your dwelling places.” - Leviticus 23:3.
But if you have ever actually read the whole Bible and all the Leviticus verses, you will find it quite looney. Leviticus 25 et al describes the proper purchasing of slaves. Yes, slavery is cool in Leviticus. Do Kacsmaryk, Barrett, and Kavanaugh want to bring back slavery?? That was not rhetorical as the answer, if they claim to adhere to the craziness of Leviticus, is an absolute yes. That’s exactly what they are bucking for here. Leviticus calls for street executions of queer folks. That’s certainly not out of bounds for the modern American theocratic Nationalist nutters looking for power and control, so yeah, that’s on their plate too. Oh, at the Post Office, are the uniforms made from a cotton-poly blend? That’s unholy according to Leviticus as well. Did Kacsmaryk’s tort theocrats sue to prohibit mixed cloth?!? Nope. But that’s the bullshit of their use of Leviticus, they pick and choose, one by one, what is actually real for their current, even momentary, purposes. None of it is actually holy, it is all a con for totalitarian control ala The Middle Ages. Will they murder farmers for planting more than one type of seed in the same field? Leviticus is ok with that and that’s how preposterous the whole Bible said claim is in real life. How do they get away with using it so easily?!? Baffling! One chapter is holy and literal when they need it to be literal, other times, not so much?!? How the heck does this play out like this?!? Pure hokum.
Do Army soldiers get the Sabbath off? They can tell their commanders “nah, today is too holy for a training exercise, I am taking the day off.”?!? Is emergency surgery at a hospital banned on the Sabbath? No!!! Why? Because it is not a real thing in real life. That’s why. Are all the firefighters off on the Sabbath? Police?? Paramedics??? Do the theocratic Nationalists get to stone to death a firefighter for responding to a residential structure fire on the Sabbath?!? Don’t be that incredulously imbecilic. Maybe the gullible play along with this bunco, but any rational person should not tolerate this nonsense for a second.
The rightwing nutters gleefully listed the ways they could impose draconian authoritarian measures to enforce the Dobbs’ decision. The far-right cranks were ecstatic over the possibility of using government intrusion and violence to start the immediate enforcement [read: a state-sponsored terror campaign] against pregnant women. The Christian Nationalists immediately pushed legislative ideas that included Stateline border checks to see if women were attempting to leave their state for some unholy purpose (read: anything they don’t like for whatever reason) and using police K9s to sniff the vaginas of women at airports because police enforcement of a vagina should replace an actual ob-gyn or some other incredibly stupid shitty thinking. They claimed this was not a push for a nationwide law banning abortions [not just “abortions” but a long list of medicines and medical procedures] then turned around and did exactly that: submitted a bill for a nationwide ban. They said they were not out to criminalize the medical profession or doctors, then they did exactly that: submitted bills to arrest and imprison doctors. Not just for performing an outpatient surgical procedure or prescribing something like mifepristone, but for talking to a patient about any abortive procedure as a possibility in their medical care. Once again, they resort to thought crimes. They literally are attempting to ban doctors from openly talking to, advising, and providing medical advice by threatening them with lengthy prison sentences.
What are the next personal and/or family decisions they will hijack next because they claim they are seated at the right hand of the Father?
If you think abortion and women will be the only thing interfered with, you would be totally wrong. Men in several states are being denied a vasectomy, in some cases, even after they have fathered several children. The theocrats believe your family planning is solely under their despotic control. Will they help put the 4th, 5th, 6th, 7th, and 8th kid through college?? Hell, no, pleb. Live in poverty trying to raise the herd or be celibate by theocratic state order. It is not up to you. The bishop-judge-governor will make all your family decisions for you. Your job is to obey. It will never stop.

The theocratic nutters want to destroy the constitutionally privileged communication between doctor and patient. Funny, it is the same passage that grants privileged communication between husband and wife, lawyer and client, and even priest and parishioners. Their zealotry is self-defeating, yet once again we see them more than willing to burn down the barn just for the opportunity to dance around the flames.
So, what is next? Think of a drug search warrant gone wrong like Breonna Taylor. In the Taylor case, the local police lied about getting criminal intel from the US Postal Service Police. I theorize they lied about the real reasons for the targeting of Taylor’s boyfriend: I have a possible investigative hypothesis that it was a personal beef between maybe the lead detective and the boyfriend. Did the Feds ever look at this as either a bad search warrant or just a robbery? As in did the boyfriend refuse to pay a bribe? Was the detective beefing over territory, or “turf”, with the boyfriend? They lied on the affidavit to support the search warrant. Then they murdered a woman asleep in her own bed in a hail of gunfire. The local police and their supporters (read: Nationalists) were instantly and gleefully justified in the criminal homicide of an innocent woman caused by a false search warrant. Why? Drugs are bad, mkay? Now just replace “cocaine” or “meth” on the falsified search warrant affidavit with “mifepristone”, and viola!! Instantly false yet self-congratulatory justification complete with fake moralism.
Stop-and-frisk for mifepristone (etc) is coming. Sure. It won’t be in Manhattan or Atherton or a wealthy white enclave in Texas, but there will be a day soon you will see another state surveillance camera documenting numerous officers formed into a sanctified street gang slowly beating to death a pregnant 16-year-old black or Latino girl because she failed to follow verbal commands in their mifepristone drug search stop-and-frisk. It is coming. I will bet money on it. The reason for beating her to death will be the same as the poor guy in Memphis, beaten to death for the sport of it. In their minds, beating to death a suspect will cause so much fear in the public mind, no one will dare use cocaine, oops, mifepristone again. Make the others fear daring to get a prescription from a licensed ob-gyn. It is seriously coming folks. Don’t pretend it isn’t.
Police tanks will be deployed to a medical clinic and/or a hospital. Search warrants will be granted on the flimsiest excuse to deploy the tanks and smash down or explosively breach the doors of the clinics. Why? Slogan: Mifepristone is the new meth. Or my personal favorite, the “think of the children” excuse. Nurses and doctors will be gunned down for making furtive moves during the mifepristone search warrants. Doctors who speak out against the violent warrants and state assassinations of medical personnel will be imprisoned under the laws that make it illegal to support even talking about pregnancy termination as a possible medical option. Even if the mother’s life is at risk.
We just sent warplanes to shoot down innocuous balloons. What if the Governor of Mississippi or Florida or South Dakota thought the Cessna was transporting a girl or a woman out-of-state for a procedure they have deemed unholy in their self-established theocracy? Yeah, I can totally see a Florida or Alabama National Guard helicopter or fighter shooting down a civilian plane over this stuff. A real, not remote or hyperbolic, possibility. They will fervently claim later they are acting in the name of god, and that always leads to a nightmare scenario.
What if the Christian Scientist sect/cult takes the political reigns in America? They do not believe in using medications, like at all. Whether it is antibiotics, vaccines, anti-depressants, sleep aids, or blood products during surgery. They refuse a bewildering list of appropriate medicine and medical procedures recommended by their own M.D. What if antibiotics are banned by a Texas Christian Scientist judge?? Already, 700,000 people die each year due to antibiotic-resistant bacterial infections. Imagine if a zealot judge who does not believe in medications because it is not in the Bible or the “Bible says…” blocked all antibiotics and ordered them to be removed from the market immediately. Overpopulation would no longer be a problem very quickly. Think about what drug, a medication, you or a loved one relies on to stay healthy or even stay alive. That is one zealot’s court decision away from getting banned according to the self-assigned rabidly ecclesiastical yet phony morality police/vicar.
Let me make something totally clear: The abortion ban under Dobbs has nothing to do with abortion itself. It is another method, in a long list of methods and excuses, to deploy a hostile militarized government against average citizens. They could not win Afghanistan, so war on Main Street, U.S.A. is the answer?? To the Christian authoritarian Nationalist, we are unworthy of being Americans, we must be policed by the system using as much violence, theft, and corruption as possible. Christian Nationalists have anointed themselves as a god, their own Yahweh, they are all-knowing, unanswerable, and they are in charge. Heathens (you, me) are not allowed to question anything. There will be no debate. They are more than willing to kill anyone in the way of their pursuit of control and power, and they are more than willing to achieve those daft goals by declaring their own jihad.
Don’t kid yourself, this is a jihad, not medicine or law. Did you know that mifepristone is also used to control high blood sugar (hyperglycemia) in patients with Cushing's syndrome who also have type 2 diabetes and have failed surgery or are not candidates for surgery? [source: Mayo Clinic] A Texas zealot just ordered a legit medicine be taken off the market immediately. Oh, mifepristone can also be used in the management and treatment of uterine leiomyomas. So according to the experts in medicine at Mayo and elsewhere, the doctors consider this a useful, proper, and helpful medication for several conditions. A Texas religious zealot threw out a medicine that was created about a half-century ago and has been in use in medical practice since 1987.
Why? Look busy, Jesus is coming…
So when you see on the news some weeks or months down the road that six police tanks, ten SWAT teams, and cops from twenty agencies are surrounding a clinic so they can fight the terrorists, remember who they are identifying as a criminal in their own personal war zone where they appoint themselves the Vicar and the Viceroy: your wife’s or daughter’s or girlfriend’s board-certified ob-gyn trying to provide the actual medical care they were taught in an accredited medical school while using FDA-approved medications.
That was the zealots’ plan from the very beginning. Fear, control, and state violence as soon as possible.
