Assault is the part of assault and battery where the suspect expresses their intent to harm someone and they have the proximity to actually complete the assault. Whatever was said on Twitter can’t be assault (no proximity), but Mullin had proximity and wanted to make that point absolutely clear. Now, if a trained fighter, the examples being a pro boxer’s fist or a black belt karate instructor, actually criminally batters someone, that is often seen by prosecutors as a felony or aggravated battery. A trained combatant attacking some random person is often seen as very fucking bad in courts all around the country.
Far-right Nazi-minded Senators are not just excusing the violence of the insurrection while espousing violent rhetoric at every turn, they are now openly willing to engage in violence themselves as a political construct. What are the enforcement mechanisms to ensure compliance with the ethical standards?? There are none. It actually does what the corrupt court member wants: Absolutely nothing.

The triage nurse of Nationalism will see you now… Just because she declared (without much supporting evidence, if any) that anonymous social media was “a national security threat” does not make it true. A pronouncement from a candidate is hardly the level of scrutiny required to throw the Constitution into a burning pile of trash.
Reminder: Pronouncements without evidence are a key part of the authoritarian playbook.
